Thanks, NY for Joining the 21st Century & the Pitfalls of New Grads Going Solo

In case you haven't heard, NY just legalized gay marriage. That's all I have to say.

It's the 21st CENTURY!!!!! This is America. I'm just glad NY finally got with the program. Now if we could only get rid of Bloomberg & my husband could find a job with an employer who truly appreciated him + gave him viable holiday vacation time, life would be so much better.

I've talked about this before but it's just pathetic and tacky for the government to use religion to deny people basic rights. Let me also add it's a religion many people don't follow or support. And a quote I read from the Catholic Bishops of New York is a laugh: treated gay people "with respect, dignity and love", did you? I wonder what gay people who grew up in the Catholic church would have to say about that. I can tell you that there are LOTS of people in the Baptist church who would be lying if they said that.

Gay people getting to marry has nothing to do with your sex-starved marriage so shove your prejudices up your butt. Unless YOUR church is being commanded to marry gay people, you have nothing to say about it.

Maybe I should lobby the government to invalidate marriages that haven't been consummated in a certain number of years or to force you to adopt 5 children every time you publicly tell women not to get abortions. How do you like them apples? Not so cool telling adults what to do when YOUR life & choices will be affected, now is it? Unless you'd like that to happen, maybe you ought to keep your trap shut.

Also read this story recently about new law graduates opening virtual offices and becoming solo practitioners. While I appreciate ingenuity and am as in tune with technology as the next person (who isn't your typical attorney), there are some serious pitfalls to doing this. As someone who's freelanced as an attorney & gotten legal clients, let me share a few facts:

1. Malpractice insurance: It's costly, particularly if you want to do entertainment law. If you're unemployed, you can't afford it. If your state doesn't require it, at least you can just opt out & tell prospective clients about that fact.

2. The ability to hustle: If you can't hustle, there's no way you'll do this successfully. I'm not so sure all new law can do it. I had the advantage of being a founding member of a sorority chapter. Plus, I've had no choice but to hustle for survival. I believe a typical new law grad who's not had to hustle or be in a position of leadership is going to have a hard time.

3. Access to people who know more than you & knowing when to use it: Just like high schoolers, I'm sure there's a group of new law grads who think they know it all & then get in over their heads with no older, wiser folk to ask for help from. Not only do you need that access (which can be hard to get from self-important jerk types who try dragging you down) but you need to know when to use it.

4. Lack of community in the legal field: Yes, I still believe there's a horrid lack of "community" in the legal field. I found it laughable when I read an ABA article saying to make friends w/other attorneys.

Okay, if you've read legal blogs on lawyer relations, you know what I'm talking about. If you haven't let me give you a short version: lawyers are assholes and total sociopaths who are nothing but sticks in the mud.

Not every single attorney I know fits this & I've managed to find some who have a shred of humanity. But...the chance of that is slim in my book. I'm also not big on the term "friend"; I call people my contacts since "friend" implies a deeper level of intimacy than I'm comfortable with. Also really doesn't help that my oldest friend in the world 180ed into a different person. These days, I hear the word "friend" and that whole thing weighs on my mind.

I also recognize that I'm an unusual person. To really be my friend is tough; I'm a private person, despite being blunt. I've had many people let me down in life & hurt me. You could say I put up barriers around myself & you'd be right. Generally, I find it hard to trust people or believe they're going to be reliable.

Plus, I'm in a field where you kind of have to put up barriers or you'd get eaten alive.

Even staying in my sorority chapter after a while was emotionally difficult; I just felt like I had to stick it out as an endurance test, to prove I could do it. I'm glad I did but I feel like I know who I am and have learned to accept it.

5. Trial and error factors: I had to do some of this. You learn there are lots of scumbags in the world & people who don't appreciate a damn thing. Believe me, your altruism fades really quick after you represent people on your own, go through a bunch of time & effort and end up with people not paying you or appreciating you. I don't take kindly to stuff like that & after bad experiences, I'm much pickier about who I deal with. It's on my terms or it's not going to happen.

Perhaps that's part of legal training: draining out nearly ounce of altruism and empathy you'd feel for a client.

I feel it's the fault of the legal profession, schools, the ABA, whoever else caused the field to be as it is that new grads are having to do this. They're doing what they have to in order to survive and pay off the ridiculous loan rates. Unlike some people, I don't punish others for doing what they need to in order to survive. As they say, some rules are meant to be broken. You just need the maturity and forethought to know which ones are good & serve a purpose vs. which ones are asinine & beg to be broken b/c they are that stupid.

General Musings Part 19

This one may end up a little longer than normal because I have some serious rants for some of it. Some could make up their own blog posts in an of themselves but I'll see what I can do to reserve some of it for separate posts.

* First off, I don't know if Betty White actually said this or not but if she did "brava." Some famous people are spoiled assholes who don't appreciate that A) most people don't make in a year what they make per movie & some make less per year than they make per TV episode, B) lots of people would trade places with them in a second & C) the criminal justice system is completely biased in favor of celebrities.

Do you think a regular person would get the same punishments, second changes, etc. as Lindsay Lohan has for doing precisely what she's done? I don't think so.

Any famous person who appreciates those facts and finds "bad behavior" reprehensible should be praised. That's a person who appreciates the admiration of the common people & presumably is in touch with them.

Yes, celebrities have to go through all sorts of stuff & I can understand why drug and alcohol addiction are so rampant in the industry but if you're going to do that stuff, not get treatment then continue to break the law and flout your superiority to others, I have zero sympathy for you. In fact, your total failure will be even more glorious to the common person. Want people to root for your success or throw parties after your death because they hate you?

* This is just funny. It makes you want to create your own town & come up with fun street names.

I was contemplating variations of the "Baby on Board" sign since I happened to see one as we were driving yesterday. I came up with "Satanist on Board" and "Flirty Homosexuals on Board." If I had one of those signs, I'd want something clever & interesting like those that just happened to be true for our situation; not sure what that would be for us. "Crazy People on Board" is just too easy.

* Oh, and do me a favor. Let's just shut up about how gay marriage is immoral and that other crap, all right? Stop persecuting gay couples & grant gay marriage in all 50 states already! Gay people are absolutely right about the fact that they're treated like second class citizens. Consider this.

Want a theocracy? Claim your own island & take all the nutbags of your faith with you. When I say "nutbags," I'm referring to people who have zero logical reasoning skills, make no effort to live in modern society and think they are Lord & Master (or Lady & Mistress) of everyone else's lives. The people who protest abortion but never adopt unwanted kids or try to reform the foster care system while also indulging doctors who demand all childfree women to breed before getting voluntary sterilization.

Better yet, move to an existing theocracy. Leave the rest of us alone & we'll leave YOU alone. Fair? Gay marriage has NOTHING to do with YOUR marriage.

Let's repeat this: a gay couple getting married has NOTHING to do with your marriage to your fundie spouse. Stop being an ass to the homosexuals because of your sexual frustration within YOUR marriage!

* Thank God I don't have kids who live in Chicago. I'd say "hell no!" to this one.

Let's see: there's the unappetizing lunches, the health content involved (to my knowledge it hasn't changed since Super Size Me), general selective eating, etc. These school board members and powers that be who made this choice should be forced to eat the cafeteria food themselves. If they wouldn't touch it or even feed it to their dogs, they have no right to demand school children to eat it if they don't have medical conditions. Meddling at its worst.

What next? Force everyone who's skinny to take injections to be just like the fat kids so the fat kids won't feel bad about themselves? I see this policy just helping anorexic kids out since they'll have a good excuse not to eat.

* Speaking of the picky eater argument, I read this Dear Prudence column yesterday.

Okay, here's the thing. I am a picky eater & there's no medical reason or some such nonsense. Nor do I need "therapy" for it.

You want to know why I'm picky? Genetics or environment, take your pick.

First off, my mom is a very picky eater. Don't give her onions, cabbage, garlic, etc. She's not going to eat it. Because she wasn't one of those hypocrites who made her kids eat things she wouldn't eat herself, we weren't given certain things as kids. No brussel sprouts, turnips, salmon, etc., etc. I also grew up in the South & certain cuisine is not good down there. This was even more true when I was younger & there were very few "ethnic" people.

Second, my family did not have the money to take us out to eat at fancy restaurants. I didn't even get to go to a casual dining restaurant to sit and eat until I was in high school and that was because I got inducted into the National Honor Society. We were lucky to get fast food once a week as kids.

Finally, most people I know do not eat "exotic fare." They are "burgers, french fries, chicken tenders" kind of people. Some of them don't eat any vegetables while others eat a few, including me.

I saw a lot of comments on this letter about how "this person eats like a little kid" and anyone who's a picky eater either needs therapy or should have their diet critiqued by snobby foodies.

That's not what I needed. I ate more things by hanging out with different people, going to college and actually getting to go places + try food without having to waste lots of money on things I might not like. That's how I got to eat Mexican food.

News for you foodies: stop playing food police & denigrating people who don't eat squid, eyeballs, tofu or other exotic fare. Shut the fuck up about what I put into MY body. It has no effect on YOU unless it causes gasiness & you're in the same general area. There's no harm to YOU because of what I eat, got it? And health concerns? Butt out & focus on your own health. I'll bet you weigh more than me.

I'd rather die at 80 eating what I wanted than live to 100 eating nothing but tofu & cardboard. Enjoy life a little; maybe then you'll remove that stick from your ass.

I've tried particular things. I don't like them, I won't eat them. If I go to a restaurant and PAY for my food, you'd better believe I have every right to have my meal without onion, cilantro, salmon or whatever I don't eat that I will taste if I simply "pick it off." However, I do like cooked asparagus and zucchini (which I never got to have without going to events as an adult). I actually had black caviar at a lawyer event that was topping an appetizer I ate & it didn't even register a taste to me; I'd eat that again.

Go to Hell if you think picky eating is a deal breaker. Many people don't live in major cities, have relatives from foreign countries or like fusion cuisine. Find a fusion or Thai restaurant in my hometown that you'd eat at and not worry about the food quality. There's a reason you won't find that kind of thing on the scale you find fast food, BBQ places, casual dining, etc. I think that's probably the case in Middle America.

Interestingly enough, no one I know has ever bitched at me about what I do or don't eat in a restaurant. If anything, the picky are saving a restaurant money because they can save that onion, red cabbage, guacamole, egg, cilantro, etc. for those who DO eat it. It's why I prefer places that make their foods in the kitchen and don't use mixes. I've also not noticed many men playing food police. Most of the ones I know are "meat and potatoes" types & some downright won't bother going to certain types of restaurants.

I also think this debate is a tad classist. The "I eat everything" folk apparently come from money or health nuts. Personally, if you are worried about that in a life partner you have very big problems and would be labeled a whiny, preachy person around "meat & potatoes" people.

* Special bravo to Prince for this. He's entirely right, you know. Ticketmaster IS the devil!

* This I would not do for an ex. Thankfully, my husband has no plans to leave me or cheat on me. We have a very simple solution for that one. It seems like children seem to play more in those decisions; one more good reason not to have kids. If you'd still been friends years later, that's one thing. Otherwise, I'd just let karma handle it.

* However, I'd do this in a second. Again, kill a family member of mine then get smug & laugh about it? I won't be responsible for my actions & I think any lawyer could have a viable argument for temporary insanity if not total insanity.

I also think the terms "little bitch" or "slut" apply to this ex-girlfriend & I'd have called her this much for making such cracks. Remember, you probably had sex with him & most likely cheated on him. What does that make YOU?

I'd also have to say "I'm sorry your family is going to have to pay for your funeral expenses because I'm going to rip your head off if you don't shut the hell up and get out of my sight permanently." These scumbags wouldn't be able to walk the streets without 24 hour security if it were me.

The world at large should be thrilled I'm only putting this kind of thing in my creative work instead of going out & doing it in real life. Give most people opportunities, you prevent criminal acts.

* And gee, why am I not shocked by this? I almost want to thank the company that left me in job offer limbo for months for not getting back to me. Now I don't have to endure the belligerent and abusive skies!

* Also not a shocker. Gee, who wants move to Sweden now? I'd consider it.

Seems part of worker abuse in America is cultural differences that allow it to flourish. If you ask me, that difference is the dumbing down and sheepledom that result.

I bet if segregation were the norm today, you have millions of apologists saying "Oh, don't cause trouble." and "Don't go protest this. You're interrupting law & order." Look at how people react toward those who protest constitutional violations in the form of TSA screenings, graduation ceremonies and high school racism. If you don't think I'm right, then you have much higher hopes for humanity (& perhaps more naivete) than I do.

* Finally, read about high school girls using Facebook to claim their prom dresses.

If you want a unique, one of a kind dress I have a more radical idea. Get someone to MAKE your dress!!! Pick a fabric & style you want. If you browse stores & the Internet carefully, I guarantee no one will be copying you + you won't be ruining the moment by announcing what you're wearing beforehand.

Or get something & alter it if you have some sewing skills. That or let someone else do it.

Ladies, you NEVER tip your hand when going to a prom. Would you post pictures of your wedding dress on Facebook if all your friends were getting married at the same time so that your friends don't copy you? Do you think celebrities do this for red carpet events? I don't think so: the element of surprise is just as important.

Plus, how do you know someone's not just going to lie & hold a dress you like so you can't wear it to then show up in something no one else "claimed?" Teenage girls can be real bitches; I was one once & I certainly could be one when I wanted to. If you've got hundreds for a prom dress, I'm pretty sure you can pay the same money to a dress maker for a one of a kind; bonus if you know someone who has the ability to do it.

So there you have it. Now I should have time to watch another movie I haven't seen this afternoon.

What the Hell is Up With People Violating Federal Law or Playing God When They're Just Customer Service Reps???

I just saw this blog post in a community I watch that reminded me of What Would You Do come to life. For those who don't know of it, there's an ABC Primetime TV show segment of 20/20 in America called What Would You Do? & it's a hidden camera situation show that creates scenarios to see how real people react to particular situations.

This particular post reminded me of episodes they've done where the waiter refused service to drag queens or gay couples with children. Guess what my take on that kind of thing is: do your damn job & leave your beliefs out of it! If you work in a service industry, your job is to serve.

It is NOT your job to preach at people, attempt to convert them to your viewpoint or do anything else aside from providing equally competent (ideally good) service that everyone else who walks through the door gets. If you want to preach at people or be a bigot, do it at YOUR church or on your OWN time.

Don't do it on your employer's time! Lawyers are required under ethics rules to simply turn down a case if they have philosophical differences on racial or gender matters. This is what I'd do if some waiter or other service person asked me to defend them in a situation like this; I have no sympathy for minimum wage service people who want to play missionary.

I worked in retail for 7 years, including in the lingerie/sleepwear department of JcPenney. If any man had asked me about lingerie at our store in a larger size, I would never have pried into his reasons or purposes for such questions; I'd simply answer them & do the job I got paid to do. One of my co-workers told me about such a situation happening to her: there was no tirade or discussion about the morality of cross dressing.

And stuff like this? Or this?

Let me break it down for you, retards: this is 2010!!! NOT 1950. We have a little thing called "civil rights." The U.S. Supreme Court decided in the early '60s that restaurants far away from major interstates can not even have segregated seating since that indeed affects interstate commerce, something the federal government has every right to control if certain states want to allow open bigotry.

If this didn't happen, you'd still have segregated bathrooms in the Deep South if Prom Night in Mississippi is any indication of current racial attitudes down there.

Apparently that's a foreign concept to Mr. Navarro, employee of Con Edison. If I were the Con Edison management, I would fire this man in an instant. Not only is he breaking NY state law, he apparently missed his calling to work with the Westboro Baptist Cult folk. You want to protest against gay people? Maybe you should join them. Spare me any talk of "Oh, this person has a family & they need a job": there's thousands of unemployed people in NYC right now who I'm sure could do this job much better and for half the salary being paid to this low life. I'm quite certain those Westboro cult folk would take care of him & his family very nicely considering they're about as beloved in America as Adolf Hitler.

I also know of a club in Manhattan that is apparently racist (the Continental) & based on what I've read about their practices, I'd never go there either. In fact, you'd better hope I don't see discrimination happening b/c I will get in your face. If you're some little underling, your boss will know about it & you'll probably get fired for exposing the company to potential big money, high publicity lawsuits. If you're the owner, I will probably call you an idiot to your face.

And if you're an actor who's doing this sort of thing??? You'll definitely not move up in your career if I see such a display since I'll tell everyone I know about it. So will anyone else in the business since no film company, no producer, no big shot needs the legal liability coming with hiring a bigot (discriminating against gay people DOES, in fact, make you a bigot). Not to mention pissing off any other minority in the business who may have worked with the big shots for years & established themselves far more than your little discriminating butt ever will.

If you're the victim, I will walk up & pull the lawyer card on the bitchy server, customer service rep, whomever. My spouse & I will also leave without paying + bigot, you'll be lucky if you simply get no tip & don't have to call the cops for your own protection. To give you an idea of my capacity for asserting myself, I read this story a few days ago & realized I'd do the exact same thing if I were in that situation.

In fact, my husband would love to see this Mr. Navarro fired considering that we as the customers of a business have every right not to bankroll homophobia, racial discrimination or anything else we find offensive. Having a bigot on your payroll, in my book, is indeed bankrolling discrimination. It's a reason I'll never give money to my undergrad: I'm not bankrolling a racist fraternity that they continue to allow on that campus.

Now I know there are racists, religious zealots, whatever who have jobs. Keep your beliefs to yourself (not let it enter your working life) & it won't be an issue. Once you do, however, it becomes your employer's and your customers' issue. If you can't evolve or at least keep your bigotry in check, I suggest moving to your own island or starting your own cult with like minded people in a distant land. For God's sake, don't live in a major city filled with people who are different from you.

And personally, I'd love to bomb those cesspools of bigots in an attempt to clean out the gene pool but that's a different story.

Short Comments on 2 Articles w/a Serious Rant at the End

Not enough for general musings but I have a couple points on 2 articles then a big time rant.

Apparently, a 21 year old guy got away w/pretending to be a 13 year old & was so good at it he was playing football in a league team for that age group. This guy's apparently a professional con artist or something & now all these people are enraged.

I might feel differently if my child were on this team but I'm more bemused at hearing this story. I think some manager ought to hire him for acting. Casting for children can be hellish & if someone can look that young w/out having to have the special rules, I'd think lots of companies would go for it. Heck, if he's that good he ought to be nominated for an Oscar.

And more utter stupidity.

Now I have no personal hatred against Texas. Many of your residents read this blog & it can't be just the liberal portion since I'm not a liberal per se. Notwithstanding the fact that someone I violently dislike but have never met currently lives there (you wouldn't like this person either), I don't really have a personal beef here.

But...just because you don't like gay marriage or find it immoral doesn't mean you should not allow gay couples to get divorced. It causes a million more problems to make a marriage impossible to get out of if you don't allow divorce to happen. In fact, the right to gay divorce is probably even more important than the right to marriage. Look at how many straight people get divorced. You have to have both or people start using serial killers as an excuse to "accidentally" kill a spouse they no longer want to be married to. Plus, like it or not, gay marriage being legal under government law is inevitable. Many states already allow it.

Even if you don't allow it in your state, Judge, you don't need to create legal nightmares that lawyers will strangle you on sight for causing. Don't you have enough problems w/crazy heterosexual ex-spouses in your courtroom? I would think judges wouldn't go creating more problems in the legal system than we already have. Are you now demanding gay couples to move to some state that allows it for months before they can get divorced b/c that is the result of such an immature & short-sighted ruling.

Finally, this just pissed me off.

Having worked someplace where sexual harassment took place, I have a real problem w/using the term "flirting" when we're talking about the workplace. This woman is telling people that it's perfectly acceptable for women to flirt to get ahead in work: the freaking article is called Flirting Your Way to the Corner Office.

So what are my fundamental beefs w/this idea. Where to begin?

1. I'm married. Now I'm a nice person & I appreciate compliments from time to time. You don't have to worry about me filing a lawsuit because you complimented my hair or my outfit. I'm also quite the humor fiend & can dish out the clever retorts when needed. It's difficult to make me truly uncomfortable.

However...I'm not going to lie to you about being married & how important my spouse is to me. You can have a conversation with me, I can give you advice, we can have a friendship at work & be on good terms. If you think my agreeing with something you say or helping you with a problem means I'm interested in you sexually, think again. We all need friends and allies in the world.

2. The whole concept of "flirting": in my mind, flirting is when you pretend to be sexually attracted to someone when you aren't. I don't think calling someone attractive or saying you'd date them if you were single is really flirting if you mean it. I never say something if I don't mean it. So I'm not a fan of the concept to begin with.

I think you start crossing the line when you write checks your butt can't cover. I was never what we'd call a tease when I dated.

For instance, I'd never give a guy a blow job if I had no intention of sleeping w/him. Now maybe we'd worked it out ahead of time but you'd never see me initiate that & then say "Oh, no I won't have intercourse with you!" I always told guys ahead of time what my intentions were & what I was comfortable with.

I also think flirting is a form of lying. I'm not about to let someone think they're eligible for something that's not on the table. One of my exes actually told me once that I couldn't flirt if my life depended on it. He said I tried but failed. This is probably true. Flirting is one of those things I'm probably too honest to do.

3. The feminist point: earn your own damn way. It would make me feel sleazy to use sex of any type to get ahead. I wouldn't take someone seriously for doing that & I know I'd judge harshly on it. Any common person can rub up on someone; it takes real skill to prove your worth honestly. You won't get my respect or a lot of people's if you try to earn it with sex.

4. Don't attractive people have enough problems already? Must you encourage further stereotypes to make it harder for people like me who don't do these things? I don't want to walk in someplace to have people think I didn't earn it honestly or that I'm going to sleep with them. I'm not Karrine Stephans, thank you very much. Like there isn't enough sleaze in certain fields already. How about we not encourage that shit???

If this was about being friendly, that's one thing. You can find common ground if you look for it. Don't lie about stuff & you won't have to worry about someone misinterpreting you. That clear enough? I'd also be pissed about someone in the workplace doing that & it would make me want to demote the person. Grown ups don't have to flirt.

The Sanctity of Marriage (Yeah, Right)

I just saw this story yesterday about NY state FINALLY getting w/the 21st century & adopting a no fault divorce law.

So people opposed to the new no fault law claim that the sanctity of marriage will be destroyed if NY adopts it? Let's consider a few things:

1. The other 49 states have a no fault divorce law & the Earth is still turning. God hasn't sent any meteors to the states allowing this or the US for legalizing abortion.
2. You can get married if you're under 18 in some states & get a quick marriage in Las Vegas. See Britney Spears.
3. Gay people aren't being allowed to get married but you can get a divorce by yourself in most places & simply say that you're just not getting along w/your spouse.

If you ask me, I think the sanctity of marriage has long since disappeared. Claiming there is sanctity in marriage today is like saying bubble gum is a health food.

Now that doesn't mean some marriages don't have sanctity. I certainly think mine does considering I love my husband, have never & would never cheat on him and don't view my relationship as "till death do us part...until someone better comes along." There are people who manage to have marriages lasting for decades & are still happy.

Problem is, the divorce rate is still very high & I'm sure the rate of unhappy marriages is up there as well especially when people can't afford to get separated.

If you want to make marriage sacred again, how about not allowing people to get married without basic counseling, full disclosures of anything that could be a deal-breaker & institute a waiting period.

Let's also not allow divorce without reasonable guidelines for domestic abuse, infidelity, etc. Finally, stop encouraging "starter marriage" or marriage with someone who's a terrible parent if you wish to have kids (to be disclosed long before you walk down that aisle).

I see no reason why gay people shouldn't get married. Not every married couple has children & it denigrates my relationship to say that gay people can't marry b/c they can't breed naturally.

If you want religious aspects in a marriage, get married at your church. Your church should also get to marry anybody it wants to & not marry people who have beliefs they don't agree with. State marriage & religious marriage should have long been separate in my opinion.

But that argument against no fault divorce in New York still makes me chuckle.
